My neighbor has a
larger building that your rules allow. How did he get away with that
and can I have a larger building also?
The zoning ordinance provides an
avenue for an applicant to request a larger building than
permitted by right, through a special use permit. This process
involves an application for the building describing the reason
for the large structure, a site plan, a filing fee, and a public
hearing with the Planning Commission. A call to the Planning
Department will answer any other questions you may have.

We want to build a
new house in Gaines Township. What are the setbacks?
All zoning districts have different
setback requirements. It depends on which zoning district your
new home will be located.

Can I put a fence on
my property?
You are permitted a fence, and may
place it right on your lot line if you are certain of the
property line. If you are considering a fence such as a stockade
or privacy fence, and it has posts exposed on only one side, the
exposed posts must be placed to your own property.
Neither your fence nor any planting
may exceed thirty (30) inches in height if it is located within
fifteen (15) feet of the Front Lot Line or any other Lot Line
which is adjacent to a street. A fence is limited to 6 feet in
height in residential zoning districts and barbed wire is not
permitted.

Where is my Front
Lot Line measured?
Generally, the front lot line is
located immediately out of the Right Of Way. To determine the
actual right of way line on your property it is necessary to
know the width of the right of way of the street on which your
property is located. Generally a street has 66 feet of
right-of-way width. Your right-of-way line would then be located
exactly 33 feet from the center of the road.

We live in a new
residential development and my neighbors have not planted grass in
their yard yet.
The township does not have
an ordinance which regulates the planting, or mowing of grass or
landscaping in residential areas at this time.
